This is the first of many Faxes to Jæren Herredsrett. To enjoy the whole story

or jumping over the Docket Nr. (i.e. Doc. 010 ) will not indicate to YOU, exactly
how these people work, and how
" rotten " our legal system is. So have fun, and get a better
picture of the Norwegian Legal SCENE.
Although these pages are presented with humour, the reader should NOT, by
any means misunderstand the seriousness
of the total situation. That being, three (3) Court officials, employees of our
legal system, utlitising their positions of
responsibility to hinder access to a Case-File, and attempt to deny an Article 25
Claimant, in violation of the Convention.
Introduction
For the uninitiated.
For the newcomer to this Site and this story, before reading this story a couple of Facts
have to be given as background to understanding the basics of this affair and which are
relevant to later developments. See notes on Lawyers
At the beginning of November 1997, I started the tedious job of arranging and checking the
documents that I
had been sent by the two lawyers I had used in this fight to see my daughters, in
preparation to lodging a
Petition to the Commission of Human Rights in Strasbourg, France.
During this process I discovered that there were numerous errors in my Case-File, this
included, inter alia,
A) Missing documents
B) Documents with NO
document numbers ( Docket numbers ).
C) Missing " In "
- Mottat - dates
D) Confusion in the
document numbering system
( Doc. Nr. 58 dated July 94, where as Doc. Nr. 50 was dated Nov 94 of the same year !!! )
E) Documents which I
had never seen.
So early November 97, I started the process to obtain copies of the missing Docs and to
complete the
case-file.

I first turned for assistance to my last lawyer, Mr. T.
Undem. This at first started out as a " no problem ", with just a question of agreeing to a date and time to pop into the office and start the process. He then went into a " Vurderings Loop ", this can be time-consuming, boring, irritating, annoying, costly in repeated telephone calls to determine what phase of the " Loop " he had reached, and a perpetual feeling of indecision, vasilation, and target disorientated. The " L O O O O P " could and did become locked, as it did on this occasion. |
As it happened this turned into a nasty " delay tactics ", disagreements and
finally an ambush by myself of
the 1997 Case-File from his offices on the 11th December '97.

This lady had moved from a private practice with the Law Firm
of Overland Gjerde Kleiberg Baumann in Stavanger in '96, to be a Judge at Jæren Herredsrett in Bryne as of 01 January 1997. I was informed later in '96 that she did excellent business representing the Barnvern ( Child Protection Agency ) for Stavanger Kommune. I also learned in late '97 that after leaving Law School she worked at Jæren Herredsrett for a time under M. Matningsdal. Yes, the same guy who gave me the Dom in 1993. |
It was only after being informed of this that ALL the "pennies dropped", and
I understood why certain moves were
made by her during the time she was my legal counsel. All the "odd" and
"funny" things which took place during
1996, suddenly clicked into place and turned very fishy as one would say. And
even more fishy and understandable
during the first half of 1998.
Question is, WHY all this fuss ?.
No reasons for refusal
were given at any time ?. What was the purpose for
either delaying or refusing the numerous requests to see the Case-File ?.
Does she behave like this to everybody ?. I very much doubt if she has heard of
Art. 6 or Art. 25.

At the same time, I had at the end of November 1997, called
Jæren Herredsrett and talked to Ms. Reime. Ms. Reime asked me to call back again in December 97, as she required some time to sort things out. Faithful to my word - and with the help of Lotus Organiser ( Thanks IBM and \ or BIG BLUE )- I called around mid December 97. |
No, said Ms. Reime, this is really very inconvenient, as at the moment we are in the
process of moving into
a new building, so could I call back in early January 1998 after they had got over the
moving problems.
It was to be this Tomato Kontor ansatt (Employee) with whom I directly, in the beginning, and later as
support to Dfm. Karlsen from whom I was to have the most resistance - she was probably
trying to be put on the Honnors List for 1999.
She and Karlsen together, clearly think that the Public is at their
disposal rather than the other way around, THEY are
at the disposal of the Public. A typical Tomato
Kontor misguided attitude.
1998
On January 5th I called Ms. Reime at the Sorenskrivers Embete.
This telephone conversation gave me the first sign of a possible problem of checking-out
the Case-File.
In fact the situation was already causing me considerable concern, as my Petition
according to Article 26
of the European Convention of Human Rights, had to leave Norway with a post mark dated not
later than the
29th of March 1998, - i.e. six months from the date of the Final Decision, which was
29 September 97.
This left me with just under 3 months to trace the violations I was claiming against
Norway.

I had moved legal representation to Ms. Målfrid Ølberg as of
early December '97 for the forthcoming Tvangsmulkt ( Bl. § 48 ) case. So the reality was, at the material time, Ms. Ølberg being responsible for up-coming Hearing at Sandnes Namsrett, and I was responsible for, from as far back as June 1996 for the Echr Petition. |
Mr. F. Karlsen.

I met Dfm Karlsen on Wednesday 24 June 1998 for the first time, when he told me to remove myself from the office and rejected and refused my request in accordance with Tvtl. §135 to see the Case-File !!!!!!!. Corruption in the Courts ?. |
The Action.
Therefore, as of 5th January '98 I had got nowhere closer to seeing the Case-File in the
Sorenskrivers possession
with my method of been amenable, and the "front" on Mr. Undem had still got
nowhere, in fact this was dead.
It then also became obvious that there was a concerted plan or disjointed move to prevent
the !! Petition being
lodged !!.
During January I tried to inspect the Case-File via Ms. Ølberg's auspices. This
failed when during a meeting in
her offices, she informed me that the Sorenskriver had given her instructions not
to even let me go through the
Case-File in her presence.

Dadwatch 1998.
Ms.Baumann.
Back in June of 1996 the lady was informed that I had " Introduced
the subject matter of this Affair "
to the Commission of Human Rights and that I intended to lodge a Petition after the Final
Decision in conformity with
Article § 25 of the ECHR.
Ms. Baumann was legal counsel from Mar. '96 to 31 Dec. '96. About mid Sept. '96 she
informed me that as of the
01 January 1997 she would be a Judge at Jæren Herredsrett.
Had this Lady, as a lawyer, done her job properly, insisted for example, - the Court
called all the April '95 witnesses I initially suggested, carried-out a proper
cross-examination of the " Loving, Caring, mother ", and ALL the other
witnesses, the situation today, 98 would be very different, All the
allegations of sexual child abuse would have been " set at NULL".
However, this did not happen.
I WONDER Why ?
Did she want to let F. Folkestad get away with such a clean sweep ?.
Why did she not object to Judge Jacobsen sitting on the "
Bench" ?
Why did she not assist, or offer assistance to draft a Petition to
Strasbourg ?.
What agreements did she come to with Folkestad to "sell"
her client to the other side ?.
Very IMPORTANT So it was
not until later, around !!! MID MAY 98
!!! that I became aware
Ms. Baumann was the SORENSKRIVER !!!! This answered a lot of questions.
I learnt that she was in temporary " Command " while the "REAL"
Sorenskriver was somewhere in Bosnia
or "down there" on some 12 month commission for the Norwegian Government.
